Determining Long-Term Disability Compensation
The South Carolina government defines long-term disability as the loss of vision or the use of at least two limbs. Other injuries may be determined as long-term disabilities by a commissioner, the person in charge of overseeing disability claims. Disfigurement is generally defined as a scar that can be seen from eight feet away.
The typical compensation rate is 2/3 of the wages a worker was earning at the time of the accident, not to exceed 100% of South Carolina’s average weekly wage. Because the average weekly wage fluctuates, disability compensation rates are adjusted every year. A disabled worker, or the family of a deceased worker, cannot receive benefits for longer than 500 weeks.
