One Killed, Other Injured in Work Accident

One worker has lost his life, and two others were injured and taken to hospitals in Houston, Texas.  The workers were a part of  the North Harris County Regional Water Authority.

The workers were working in oxygen deficient environments.  The oxygen levels of the man holes these workers were working at less than the amount of oxygen required to survive.  

One of the workers fell into the hole, after looking into it from the side.  This man was lifted out of the man-hole by emergency workers after spending over 40 minutes in the hole.  In a separate incident, two other workers were down in one of the holes for a period of time before they started to run into trouble.

Repetitive Injuries Pose Danger to Workers

Manager Sentenced to Prison for Cover Up of Plant Injuries

A manager at a pipe foundry in Phillipsburg has been sentenced to 41 months of prison after being charged with obstructing federal investigators in multiple incidents.  The investigators were reviewing the plant, and accidents that have occurred at the plant in the past.

The man involved claims that he has done nothing wrong, and that he did not hinder the investigation.

One of the charges against the man related to his involvement in obstructing the investigation in a fork lift accident that killed a worker.   Another charge related to a log book that did not keep proper logs of work place injuries.  For example,  a incident where a worker broke his leg was not in the log.

Rise in Workers Compensation Costs Attributed to Prescription Drug

A recent report indicates that workers compensation costs attributed to pharmacy and prescription drug costs have risen in the last few years, even though the number of work place injuries has been declining for those years.

It found that pharmacy costs attributed to around 14% of all medical spending.  The report also found that pharmacy costs for workers compensation increased by 5.4% for 2008. 

A large factor in the increase of the costs in 2008 was attributed to Oxycontin.  The price of Oxycontin increased for this year, as well as a lack of available generics.

Executives Charged in Workers Comp Fraud

Two executives with a janitorial services company have been arrested for committing a large fraud operation.  According to authorities,  the fraud involved over $6.3 million dollars worth of workers' compensation insurance fraud.

The two individuals operate a company out of California,  and were arrested earlier this week on the charges. The two individuals misrepresented information with the company, and claimed that it had only two workers. This is not true, as over a hundred individuals were employed.  Millions in premiums were not paid as a part of this scheme.

Mental Harm and Workers Compensation

It is difficult to claim workers compensation for mental harm that occurs while on the job.  Tennant v. Beaufort County School District is a case where the state Supreme Court decided against the teacher who claimed that she deserved workers compensation because of mental harm which she claims occurred on the job.

The court essentially decided that although some cases of workers compensation can be given for mental harm,  that the proof of that mental harm must be severe and must be an unusual event or situation related to that job.  In the case of Tennant v. Beaufort County School District, the court ruled that this was not the case.
