Groups Claim Proposed South Carolina Workers' Comp Law Unfair

by Administrator 18. February 2009 06:10

South Carolina lawmakers have proposed a bill which would cut workers' compensation benefits for illegal immigrants.  Under the proposed law, illegal immigrants injured on the job would have their medical expenses covered, but would not be entitled to disability benefits.

Hispanic advocates and some state lawmakers spoke out against the bill, saying it would unfairly treat immigrant workers.  According to one lawmaker, the bill would penalize doctors, hospitals and immigrant workers, while benefitting insurance companies.  The lawmaker cited a recent study which showed that Hispanics die more often on the job, and tend to take jobs which are more dangerous in nature.

Meanwhile, another lawmaker, State Sen. Tom Davis, suggested that illegal immigrants should receive no state benefits whatsoever.  Davis said he would like to limit immigrants' overall access to the state court system, in addition to limits on workers' compensation.

Filing for or receiving workers' compensation can be a complicated legal process.  If you or someone you know has been injured at work, it is important to have expert legal representation.  Contact the Charleston workers' compensation attorneys of The Steinberg Law Firm at 843-720-2800.

Bill Would Give Injured Workers Say in Choosing a Doctor

by Administrator 16. February 2009 05:00

Lawmakers in Iowa are considering a bill that would give workers injured on the job more say in choosing a doctor to treat them.  Labor representatives praised the bill, while employers argued it would raise workers' compensation insurance premiums.

The proposed bill would allow employees to predesignate a physician to treat future workplace injuries.  If the employee did not choose to predesignate a doctor, the employer's doctor would be used in the event of an on-the-job injury.  Furthermore, the bill would make it illegal for an employer to influence an employee's choice of physician.

A total of 35 states have enacted similar legislation.  Employee organizations said employer-chosen doctors often recommend more conservative treatments, and tend to put employees back to work as quickly as possible, without consideration of employee wellbeing.

Car Wash Worker Nearly Killed On The Job

by Administrator 11. February 2009 06:45

A Massachusetts woman has shown that automated car washes can be very dangerous for those around them.  Golden Nozzle Car Wash employee Stephanie Carpluk lost consciousness on Sunday, after her scarf got caught in a moving scrubber brush.

Carpluk was left with two black eyes and a few scrapes following the incident, but her injuries could have been far more severe if not for a heroic passerby.  Car wash customer John O'Leary noticed that Carpluk was in danger, jumped out of his car and freed her from the scrubber brush.

O'Leary then performed mouth-to-mouth resuscitation on Carpluk, who was then taken to the hospital.  She was released on Tuesday and is expected to make a full recovery.

The incident remains under investigation.
