Who is Eligible?
The good news for South Carolina workers is that virtually all employees are covered by the provisions of the state’s laws on the matter. Unless you are employed by a railway company, the Federal government, an agricultural business, or a small company with fewer than 4 employees, you are probably guaranteed access to these benefits. Failure of your employer to comply with the legal mandate may be punishable by a legal action seeking financial compensation for your medical care and other damages. The benefits paid are issued as follows:
- The rate of compensation is to be calculated at 66 2/3 % of the average weekly wage for the preceding year if unable to work for 7 days or more
- If the injury keeps an individual from working for more than 14 days, the benefits are payable from the time of the accident
- The average weekly wage cannot exceed $681.36 during 2009
