Disability Payments for Loss of Limb Part I
Typically when considering workplace injuries that result in the loss of a body part or its function, the extremities come to mind. We tend to think first of intense physical labor and the unique dangers of construction, manufacturing, and other trades where sharp, heavy, and hazardous tools and equipment are an accepted part of the occupation.
But different workplace accidents and occupational health risks can affect any organ, body part, or physical capacity. The South Carolina Code establishes a schedule of disability payments for the loss of function or compromised function for many organs that are not immediately obvious.
If you have been hurt in a workplace accident that has cost you the use of a body part or the effectiveness of a bodily system, contact the Charleston workers’ compensation lawyers of the Steinberg Law Firm at 843-720-2800. Let us help you pursue all the benefits to which you are entitled.
Weeks of Compensation
Generally, the law has sought to offer disability payments for a period of time roughly correlated to the significance of a body part and its importance for one’s employment opportunities. The maximum number of compensable weeks for the following organs, members, and parts as outlined by South Carolina law are:
- Kidney – 400 weeks for total loss; 25-250 weeks for compromised function
- Lung – 400 weeks for total loss; 25-250 weeks for compromised function
- Pancreas – 500 weeks for total loss; 10-250 weeks for compromised function
- Spleen – 25 weeks for total loss; 2 ½-25 weeks for compromised function
