Choosing a State

The nature of the modern business environment is almost unrecognizable when compared to the one observed a mere one or two centuries ago. Workers’ rights have made huge strides forward, and the types of employment available and range of responsibilities that these opportunities may entail has expanded dramatically.

For example, it used to be common practice for a craftsman to apprentice under a master and then to remain employed in the same shop for the duration of his career. But speedier travel and complex corporate networks have spread the physical reach of a position far and wide, a condition which has led to an interesting facet of South Carolina Workers’ Compensation Law.

If you have suffered a workplace injury or developed an occupational illness or disease, contact the Charleston workers’ compensation lawyers of the Steinberg Law Firm at 843-720-2800. Let us help you choose the appropriate state laws under which to file of your workers’ compensation claim.

Hiring, Working, Traveling

For large and mid-sized companies, it is not uncommon to have a corporate headquarters, regional offices, and satellite job locations as individual projects arise. As a result, a professional may be technically hired in a state other than that where he or she performs the bulk of regular work assignments. In positions where travel is a necessity, the list of states where an employee’s work is done can grow to be quite large.

Why does this matter? Well, under South Carolina Workers’ Compensation Law, all employees who are covered by the relevant statutes are permitted to file their benefits claim pursuant to the laws of any of the states in which:

  • He or she was initially hired
  • He or she is regularly employed
  • He or she sustained a workplace injury or illness
